A public or government entity may be liable for this terrible accident
if there was prior notice that the tree constituted a dangerous condition
of public property. Claims against public entities have an accelerated
statute of limitations period and must filed within six months of the
date of the accident.
If a private landowner owned the property adjacent to the roadway they
could also potentially be responsible on a premise liability theory if
they were aware that the tree posed a danger to motorists and failed to
remedy the situation. Victims of trucking accidents and their families
deserve an experienced trucking accident lawyer who will investigate all
potential sources of liability.
