U-Haul Truck Strikes School Bus in Victorville injuring 13 Children

A frightening truck accident occurred on October 11, 2012, in Victorville, California. A school bus loaded with children from Galileo Academy was travelling on Nisquali Road between Second and Third Streets when it was struck by a U-Haul truck.
According to the California Highway Patrol, the U-Haul truck backed up from a driveway directly in front of the school bus. The driver of the school bus attempted to a swerve to avoid the truck but the rear of the U-Haul truck struck the back of the bus sending it spinning out of control.
According to a San Bernardino County Fire Department spokeswoman, thirteen students and the bus driver sustained injuries. The injuries of two of the students were described as serious but not life-threatening. Several of the students were taken to Loma Linda University Medical Center for treatment. At The Matiasic Firm, our thoughts are with all the students in hopes that they make a speedy and complete recovery.
California Highway Patrol Investigators have not yet identified the cause of this trucking accident, but it is possible that driver inexperience contributed to this accident. U-Haul trucks are commonly rented by drivers who do not have the adequate experience to safely operate the large vehicles. Big-Rig truck drivers must comply with strict United States Department of Transportation rules and regulations regarding driver testing and training. In contrast, the operators and renters of U-Haul trucks do not have to comply with the same stringent testing and training requirements. This is problematic considering that the safety concerns and challenges involved with the operation of U-Haul trucks are similar to those involved in the operation of big-rig and commercial trucks.
Another possible factor that contributed to this accident is driver inattention. Based on the preliminary reports, it appears that the U-Haul driver inattentively backed up into the road directly in front of the school bus. The driver can be held liable for the injuries sustained in this accident if driver inattention is found to have been the cause.
As this accident demonstrates, a moment of truck driver negligence can have devastating consequences. Truck operators and possibly their employers are responsible for compensating any victims for all of the damages that they have incurred. This can include damages for medical expenses, lost income, property damage, mental anguish, pain and suffering.
