Trucking Accident Claims the Life of Cupertino Woman

A devastating trucking accident claimed the life of a Cupertino woman on January 15, 2013. The victim has been identified by the Santa Clara County Medical Examiner’s Office as 79-year-old Xiulin Du of Cupertino. At The Matiasic Firm, our thoughts and prayers are with the victim and her family.

This preventable trucking accident occurred around 7:00 a.m. at the intersection of Cupertino Road and Foothill Boulevard. According to published reports, Ms. Du was crossing Cupertino Road in a marked crosswalk when she was struck by a big-rig delivery truck. The truck was owned and operated by the foodservice corporation Sysco. Investigators from the Santa Clara County Sheriff’s Office have not yet disclosed the cause of this tragic accident. Some common causes of trucking accidents include:
  • Tired drivers
  • Tire blowout
  • Driver inattention
  • Unsafe lane changes
  • Driver inexperience.
The employer, Sysco, can be held liable if employer negligence contributed to this terrible accident. Employers have responsibilities to ensure that all of their truck drivers are experienced and responsible. A thorough background check must be conducted before the hiring of any commercial truck driver. Employers must verify that each driver holds a current commercial driver’s license and obtain an updated driving record for each driver annually. Employers are also required to maintain their fleet of trucks in good mechanical repair. An employer who fails to fulfill these and other important responsibilities can be held liable for any harm caused by the negligence of its drivers.
