Devastating Trucking Accident in San Jose Kills 23-year-old Shayla Cypriano

Tragedy struck San Jose when a pedestrian was killed on June 13, 2013, as the result of a trucking accident. Several reports indicate that 23 year-old Shayla Cypriano was walking her bicycle across an intersection when a commercial delivery truck and a dump truck collided. After the trucks collided, the commercial delivery truck flipped on its side and landed on Ms. Cypriano. Emergency personnel responded to the scene where the victim was pronounced dead. Tragically, this terrible accident was the seventeenth pedestrian death in the San Jose area this year.

The accident took place at the intersection of Auzerais Avenue and Lincoln Avenue at 9:43 a.m. The commercial delivery trucking was heading west on Auzerais Avenue while the dump truck was traveling South on Lincoln Avenue. Local officials are in the process of conducting an investigation to determine the cause of the collision.

Ms. Cypriano was the mother of 2 year-old Olivia, and had recently started a new job at a local pet grooming shop. According to published reports, Ms. Cypriano was three blocks from her destination, Grooming Extraordinaire, when she was killed. At The Matiasic Firm, our thoughts and prayers are with Ms. Cypriano's family, friends, and her daughter Olivia in their time of unimaginable grief. We encourage members of the community to contribute to a memorial fund for Olivia that has been established through the United Security Bank in Campbell, California.

As this accident demonstrates, commercial trucks can present an enormous threat to the safety of pedestrians and cyclists. To ensure the safety of pedestrians and cyclists, trucking companies are required to conduct thorough background checks and to ensure that all truck drivers have a valid commercial driver's license. If an employer fails to verify that all of its drivers have the requisite driving skills and experience, it can be held liable for any accidents caused by its drivers.

The truck drivers can also be held individually liable if their negligence contributed to this devastating accident. Some common causes of truck driver negligence that can cause fatal trucking accidents include: aggressive driving, intoxicated drivers, failure to maintain lanes, unsafe lane changes and tired drivers.
